What is a Will?
A Will is a legal document that sets out how and to whom your assets are distributed to when you pass away.
Why is a Will important?
A Will is important because it ensures that your assets go to the people you want them to go to. It also helps to avoid any unnecessary legal complications for your family after you pass away.
Can I use my Will to nominate a guardian for my minor children?
Yes, you can use your Will to nominate a guardian for your minor children (under 18). However, the nomination can’t override the rights of the natural guardian of the minor.
Who can make a Will?
Anyone 16 years or older, who is of sound mind, is considered competent to make a Will.
Who can be a beneficiary?
Anyone who you want to leave your assets to, like a family member, a friend, or a charitable organisation.
If a beneficiary in your Will is a minor (under the age of 18), a testamentary trust should be created in the Will for the benefit of the minor.
If there is no testamentary trust, the minor’s inheritance will be paid over to the Guardian’s Fund (which is a government-controlled entity).
